Sex Offender Residency Ordinance

On February 16, 2013 a City of Augusta ordinance went into effect restricting the residency of certain sex offenders. This ordinance is enacted pursuant to Title 30-A M.R.S.A, section 3014. This ordinance is intended to be coextensive with the maximum residency restrictions permitted by Title 30-A M.R.S.A, section 3014.

Chapter 13 Section 13-28 Residency Restriction for Sex Offenders, restricts the residency of persons convicted of Class A, B or C sex offenses committed against persons who had not attained 14 years of age at the time of the offense. Any such ordinance is limited as follows. This restriction is 750 feet from the real property comprising a public or private elementary, middle or secondary school and the real property comprising a municipally owned property where children are the primary users.
